Terms of Service

These Terms govern your use of Marginalia (the "Service"), operated by Jacques Bartoli, a registered auto-entrepreneur in France ("we", "us"). By signing up, you agree to these Terms.

1. The Service

Marginalia is a paid subscription that syncs highlights and handwritten notes from your reMarkable tablet to third-party destinations including Obsidian, Notion, and Readwise. We also provide a setup helper for enterprise / captive-portal Wi-Fi networks that the official reMarkable software cannot handle.

2. Eligibility

You must be at least 16 years old and able to enter a binding contract under your local law. If you sign up on behalf of a company, you confirm you are authorised to do so.

3. Subscription, trial, and pricing

  • Plans are monthly (€7/month) or yearly (€59/year). Prices include all applicable taxes where required.
  • New users get a 7-day free trial with no credit card required. The trial converts only if you choose to subscribe.
  • Subscriptions renew automatically at the end of each billing cycle until cancelled.
  • We may change prices for future billing cycles with at least 30 days' notice by email. Existing paid periods are unaffected.

4. Payment

Payments are processed by Stripe acting as Merchant of Record (Stripe Managed Payments). Stripe collects and remits any applicable VAT, sales tax, or GST on our behalf. Your card is charged by Stripe; we never see or store card details.

5. Cancellation and refunds

  • You can cancel your subscription at any time from your account page or by emailing hello@marginalia.pro.
  • Cancellation stops future renewals. The Service remains active until the end of the period you have already paid for. We do not pro-rate refunds for partially used months.
  • EU consumers have a 14-day right of withdrawal under Art. L221-18 of the French Consumer Code. By starting to use the Service during the trial or paid period, you expressly request immediate performance and acknowledge that the right of withdrawal is lost once the Service has been fully delivered for that period.
  • If your subscription becomes overdue (failed payment), we will retry and notify you. After a 30-day grace period without successful payment, the subscription is terminated and access revoked.

6. Acceptable use

You agree not to: (a) reverse-engineer or attempt to circumvent the Service; (b) use it to infringe third-party rights; (c) resell access without our written consent; (d) abuse our infrastructure (e.g. excessive automated requests beyond what a normal user would generate).

7. Your content; intellectual property

  • Your reMarkable content remains yours. We claim no ownership over highlights, notes, documents, or any data you sync through Marginalia.
  • You grant us a limited, non-exclusive licence solely to process and transmit that content for the purpose of providing the Service.
  • The Marginalia name, logo, software, and website are our proprietary intellectual property. You may not copy, modify, or redistribute them except as expressly permitted.

8. Third-party services

Marginalia connects to third-party services you authorise (reMarkable Cloud, Notion, Readwise, Obsidian, etc.). We are not responsible for outages, policy changes, or breaches of those third parties. Their respective terms apply when you connect them.

9. Warranty disclaimer

The Service is provided "as is" and "as available". We do not warrant uninterrupted operation, error-free sync, or compatibility with every reMarkable firmware or third-party app version. Statutory warranties for consumers under French and EU law remain unaffected.

10. Limitation of liability

To the maximum extent permitted by law, our total aggregate liability arising out of or relating to the Service is limited to the amount you have paid to us in the twelve (12) months preceding the event giving rise to the claim. We are not liable for indirect, incidental, or consequential damages, including loss of data, loss of profits, or business interruption. Nothing in these Terms limits liability for gross negligence, fraud, or any liability that cannot be excluded by law.

11. Termination by us

We may suspend or terminate your account if you materially breach these Terms, if required by law, or if continuing the Service to you would expose us to legal or security risk. Where reasonable, we will give notice and an opportunity to cure. On termination you may export your data on request.

12. Changes to the Terms

We may update these Terms. Material changes will be notified by email at least 14 days before they take effect. Continued use after that date constitutes acceptance.

13. Governing law and jurisdiction

These Terms are governed by French law. Disputes are subject to the exclusive jurisdiction of the competent courts of France, except where mandatory consumer protection rules in your country of residence give you the right to bring proceedings locally. Consumers may also use the EU Online Dispute Resolution platform: ec.europa.eu/consumers/odr.
